Terms and Conditions – Wedding Music Packages

These Terms and Conditions (“Terms”) govern the provision of wedding music services by Niamh O’Connor (“the Provider”) to the client (“the Client”). By confirming a booking with a deposit and/or when making a booking through niamhoconnor.ie, the Client acknowledges and agrees to be bound by these Terms.
1. Booking and Deposit
1.1 A booking shall be deemed confirmed only upon receipt of a written booking confirmation from the Provider and payment of a deposit equivalent to ten percent (10%) of the total fee.
1.2 The deposit is strictly non-refundable, save where the Provider cancels the engagement pursuant to Clause 4.
1.3 The balance of the fee shall be payable in full no later than 30 days prior to the Event Date. Failure to remit payment by the due date shall constitute a material breach of contract and may result in cancellation of the booking, with the deposit retained by the Provider.
2. Client Cancellations
2.1 All cancellations must be communicated in writing.
2.2 In the event of cancellation by the Client:

The deposit shall be retained by the Provider in all cases.

Where cancellation occurs less than 6 months prior to the Event Date, the Client shall remain liable for up to one hundred percent (100%) of the agreed fee, at the Provider’s discretion, to compensate for loss of earnings and commitments made.
3. Provider Cancellations
3.1 In the unlikely event that the Provider is unable to perform due to illness, accident, or other unforeseen circumstance, the Provider shall use reasonable endeavours to arrange a suitable replacement performer.
3.2 If no replacement can be secured, all monies paid by the Client, including the deposit, shall be refunded in full, and the Provider shall have no further liability to the Client.
4. Event Details and Client Obligations
4.1 The Client shall provide accurate details regarding the Event, including but not limited to venue, timings, and special requirements, at the time of booking.
4.2 Any amendments to the Event details must be notified in writing no later than 10 days prior to the Event Date. The Provider reserves the right to refuse material changes if unreasonable or impracticable.
4.3 The Client shall ensure that the venue is adequately equipped and licensed for live music performance, and shall provide:

Suitable performance space;

Access to electricity where amplification is required;

Reasonable time for set-up and soundcheck (minimum of 90 minutes prior to performance).
5. Force Majeure
The Provider shall not be liable for any failure or delay in performance arising from circumstances beyond reasonable control, including but not limited to acts of God, extreme weather, venue failure, pandemic restrictions, industrial disputes, or governmental action.
6. Limitation of Liability
6.1 The Provider’s liability for any claim arising out of or in connection with these Terms shall be limited to the total amount paid by the Client under the booking.
6.2 Under no circumstances shall the Provider be liable for indirect, incidental, or consequential loss or damage.
7. Media and Promotion
Unless otherwise agreed in writing, the Client consents to the Provider capturing and using photographs, audio, or video recordings of the performance for promotional purposes.
8. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of Ireland. The parties irrevocably submit to the exclusive jurisdiction of the Irish courts in relation to any dispute arising hereunder.
